COX, Justice. The defendants, who were jointly indicted under the provisions of G.L.(Ter.Ed.) c. 272, Â§ 19, for the unlawful use of a certain instrument on the body of the Spencer with intent to procure her miscarriage (see G.L.[Ter.Ed.] c. 277, Â§ 79, Abortion), waived their rights to trial by jury (G.L.[Ter.Ed.] c. 263, Â§ 6, as inserted by St.1933, c. 246, Â§ 1), and were found guilty by a Judge of the Superior Court, by whose order the trials were made subject to the provisions of G. L. (Ter.Ed.) c. 278, Â§Â§ 33A to 33C inclusive.
